If the federal courts actually follow the law, President Trump cannot be prevented from “reprogramming” funds appropriated for the U.S. Department of Defense and actually using the military (such as the U.S. Army Corps of Engineers) to build the border wall.
Congress has given a president the power to declare a national emergency by 50 U.S.C. 1621 and 50 U.S.C. 1622. A declaration of an emergency allows the President to reprogram funds in the military budget. See 33 U.S. Code § 2293 “Reprogramming during national emergencies.”

Barack Obama declared 13 national emergencies, 11 of which continue to this day.
The Obama emergencies included the Swine Flu, Flint water crisis and Iran.

We know that a big time lawyer for the Mexican cartels donated to Hillary Clinton. We also know that it was reported that Julian Assange reported that he had evidence that the Clinton Foundation received $15 million from the Mexican cartels. On 9 January 2017, the web site Times.com.mx published an article reporting that Mexican Drug kingpin Joaquín “El Chapo” Guzmán had donated millions of dollars to Hillary Clinton’s 2016 presidential campaign, claiming that WikiLeaks founder Julian Assange had broken the news.

Now this – Yesterday’s bill approved by Congress (the House is run by Democrats) and presented to President Trump includes wording that prevents the wall being built in areas where the cartels are prominent.
A key provision in the spending bill being presented to President Trump for signing stipulates that the federal government give specific Texas border counties the opportunity to derail any efforts to build barriers, fencing, or walls by simply opposing the construction of the border security measures–but many of the specified counties have a long and recent history of top officials taking bribes from the Mexican Gulf Cartel. The National Emergency authority goes well beyond the narrow issue of building a wall. This will also allow Trump to overrule the nonsense in the appropriations bill that will pass today. The restrictions and limitations of that action will only apply to the monies appropriated by that bill which is only for the next 7 months. Trump can easy get around those restrictions by reprogramming other funds. The Democrats and the media will squeal like stuck pigs, but Trump but will be able to, you know, trump them.

President Trump will take dramatic actions to fund his long-promised border wall and declare a national emergency, which will enable his administration to move $8 billion from various federal agencies to fund the project, a senior administration official told Fox News late Thursday.
The news comes as Trump is expected to sign a House border security package that provides $1.4 billion for the project, which is far below the $5.7 billion Trump insisted he needed and would finance just a quarter of the 200-plus miles he wanted.
Sarah Sanders, the White House press secretary, said earlier today that Trump will sign the spending bill and declare a national emergency at the same time tomorrow morning.
The White House said he’d sign the legislation but act unilaterally to get more, prompting condemnations from Democrats and threats of lawsuits from states and others who might lose federal money or said Trump was abusing his authority.

President Donald Trump said on Friday that he is expecting the Court of Appeals for the 9th Circuit to block his emergency declaration to build the wall — but that he will take it to the Supreme Court where he believes that he will win.
While the president was open about expecting to be sued for the National Emergency, he said that he believes the declaration will “get a fair shake” in the Supreme Court.
“We will possibly get a bad ruling, and then we’ll get another bad ruling and then we’ll end up in the Supreme Court,” Trump said during a press conference at the White House.
